Welcome to pixie.haus! These Terms of Use ("Terms") govern your access and use of the pixie.haus platform ("Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with these Terms, do not use the Service.
1. Services Provided
pixie.haus offers the following services:
- AI-Powered Content Generation: Users can generate pixel art, sprites, and animations using a curated selection of state-of-the-art AI models. We continuously update our model roster to provide the best balance of quality, speed, and cost. For a current list of available models, please refer to the generation interface on the platform. All models are licensed to allow commercial use of the content you create.
- Public Gallery and Community Features: Users can publish their creations in a public gallery, earn credits through tips from other users, and "collect" artwork published by the community.
- Online Pixel Art Editor: The platform includes a basic editor that allows users to make adjustments to AI-generated images or create new pixel art from scratch. Using the editor to create art from scratch does not require credits.
2. Ownership and Licensing of Generated Content
2.1 Ownership of Generated Images
When you generate original images using pixie.haus, you own the rights to the images you create. You are free to use, sell, and distribute these images for both personal and commercial purposes, regardless of whether you choose to publish them on our platform or keep them private.
2.2 Licensing to pixie.haus
The rights you grant to us depend on whether you choose to keep your content private or share it publicly:
- Private Content (Hosting License Only): For images you generate but do not publish to the public gallery, you grant pixie.haus a limited, worldwide, royalty-free license solely to host, store, and display the content to you for the purpose of providing the Service. We do not claim any rights to use your private images for marketing, promotional materials, or AI model training.
- Public Content (Broad License): If you choose to publish images to the public gallery, you grant pixie.haus a perpetual, non-exclusive, worldwide, royalty-free license to use, host, store, display, reproduce, modify, and distribute the content for promotional purposes, platform improvement, and future AI model training. Publishing also grants other users the right to "collect" and use your creation within the platform in accordance with these Terms.
2.3 User Responsibility
You are solely responsible for the content you generate and for ensuring it does not violate any laws or these Terms. You agree to use the Service responsibly and ethically.
2.4 User-Generated Content and Third-Party Rights
You agree not to generate content that infringes on any third-party intellectual property rights, such as copyrights or trademarks. For example, generating images of well-known characters from video games or films may be subject to copyright laws and should only be used in a manner that constitutes fair use or as non-commercial fan art. You are responsible for ensuring you have the necessary rights for your intended use.
3. Content Standards and Moderation
3.1 Quality and Public Content Standards
All images you publish to the public gallery on pixie.haus must meet a reasonable quality standard and be suitable for a general audience. The following content is strictly prohibited in the public gallery:
- Nudity or sexually explicit images (NSFW)
- Hate speech or symbols of hate
- Content that incites violence or promotes harm
- Images designed to harass or threaten individuals or groups
Private Generation: You may generate NSFW content for private use only if you have enabled the "NSFW Allowed" setting in your account and confirmed you are over 18 years of age. Attempting to publish NSFW content to the public gallery is a violation of these Terms.
3.2 Artistic Freedom and Controversial Content
We value artistic freedom and recognize that controversial themes can have artistic merit. However, such content must maintain a high standard of taste. Moderators will review submissions, and you acknowledge that content deemed inappropriate may be removed at our discretion.
3.3 Moderation Actions
pixie.haus reserves the right to moderate content and user accounts at its discretion. If you violate these Terms, we may take actions including:
- Unpublishing: Removing your content from the public gallery.
- Publish Ban: Restricting your ability to make new content public.
- Quarantine: Placing your account in a restricted state where public sharing and credit usage are disabled.
- Suspension or Ban: Temporarily or permanently terminating your access to the Service.
4. Credits and Payments
4.1 Credit System
Credits are the currency of the platform, used for generating AI content and tipping other users. Credits can be purchased and do not have an expiration date.
4.2 Credit Policy and Refunds
All credit package purchases are final and non-refundable. Credits cannot be exchanged for cash. However, credits will not be deducted for a generation that fails due to a technical error on our part. The quality of AI generations is not guaranteed and depends on many factors, including the prompt and inherent randomness.
4.3 Credit Issues
If you believe credits were deducted incorrectly or experience any issues, please contact us at support@pixie.haus, and we will investigate the matter.
5. User Conduct
You agree to use the Service in compliance with all applicable laws and regulations. You may not use the Service to:
- Violate any local, state, national, or international laws
- Interfere with the security or functionality of the Service
- Upload or distribute viruses or other harmful software
- Engage in fraudulent, abusive, or illegal activities
6. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and are fully responsible for any activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
7. Modifications to the Service
pixie.haus reserves the right to modify or discontinue any part of the Service, temporarily or permanently, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
8. Termination of Access
We reserve the right to terminate or suspend your access to the Service at our discretion, without prior notice, if you violate these Terms or engage in conduct that we deem harmful to the platform.
9. Limitation of Liability
pixie.haus and its affiliates, partners, and employees will not be liable for any damages resulting from your use of the Service, including but not limited to, indirect, incidental, special, or consequential damages.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of Poland. Any disputes arising from these Terms or the use of the Service will be resolved in the courts of Warsaw, Poland.
11. Changes to the Terms
pixie.haus may update these Terms from time to time. You will be notified of significant changes, and your continued use of the Service will constitute your acceptance of the revised Terms.
